HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CIVIL REVISION PETITION No.3425 of 2012 ORDER:

Heard both sides and perused the grounds of revision and the impugned order of the lower Court dated 15.02.2012 in appointing advocate commissioner under Order XXVI Rule 9 CPC for local inspection and to note down the existing physical features and existence of the wall between the open plot of plaintiff and house of defendant, which is no doubt described by the plaintiff as if a common wall, in allowing the petition for appointing advocate commissioner for said purpose, but for to say under the guise of mention of nature of wall by the Commissioner, he cannot describe the wall as common wall and wall of any party, but for the Court to decide. Accordingly and in the result, the Civil Revision Petition is disposed of for nothing to interfere with the order of the lower Court.

Consequently, miscellaneous petitions, if any shall stand closed. No costs.
