O R D E R

The grievance of the petitioner in this writ petition is that the 2nd respondent is not registering the crime on the complaint lodged by him against the unofficial respondents 3 to 8. Therefore, he seeks direction to register the crime against them and take appropriate action. Heard the learned counsel for the petitioner. Learned Assistant Government Pleader for Home, produced written instructions of 2nd respondent, stating that a preliminary enquiry was conducted on the complaint of the petitioner, which reveled that already civil suit vide O.S.No.111 of 2014 on the file of Senior Civil Judge Jagtial, is pending adjudication between the parties and the subject matter in the complaint is of civil in nature and the same was intimated to the petitioner for seeking redressal in a competent court of law. But the learned counsel for the petitioner disputes the same.

From the allegations made by the petitioner it could be seen that the petitioner obtained ad interim injunction order in the suit filed by him in O.S.No.111 of 2014 and the same is stated to be in subsistence and in spite of the orders of the civil court, the unofficial respondents are interfering with his possession and threatened him with dire consequences. In these circumstances, the writ petition is disposed of directing the 2nd respondent to take action on the complaint of the petitioner in terms of the guidelines laid down by Apex Court in LALITA KUMARI v. GOVERNMENT OF UTTAR PRADESH1. Miscellaneous petitions pending, if any, shall stand closed.
