THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.8510 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the in action of the respondents herein not reckoning the suspension period from 01.08.2003 to 01.08.2007 for all purposes including service benefits like gratuity, monetary benefits, difference of pay and allowances due in pursuance of proceedings No. SSDC/ADMN/retirement/ 013/201314/4010 dated 25.01.2014 and also in pursuance of acquittal in C.C. No. 388 of 2003 on the file of Judicial Magistrate of I class Dharmavaram District Kurnool dated 30.04.2008 as arbitrary, illegal, unjust, contrary to law and also inviolation of article 14 & 21 of constitution of India consequently direct the respondents herein to grant all such service/monetary benefits."

Heard Sri P. Sridhar Rao, learned counsel for the petitioner and Sri M. Srinivasa Rao, learned Standing Counsel for respondent.

When the matter is taken up, it is submitted by learned counsel for the petitioner that for redressal of the grievance of the petitioner, the petitioner herein submitted a representation on 2404-2014 to the respondent herein and no orders have been passed on the said representation so far. A request is made by the learned counsel for the petitioner to direct the respondent to pass appropriate orders on the representation, dated 24-04-2014, in accordance with law, by fixing some timeframe. The said request is not opposed by the other side.

For the aforesaid reasons, the writ petition is disposed of, without expressing any opinion on the merits of the matter and entitlement of the petitioner, directing the respondent to consider and pass appropriate orders on the representation, dated 24-042014 said to have been submitted by the petitioner herein, in accordance with law, within a period of six (6) weeks from the date of receipt of a copy of this order.

Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
