HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.44779 of 2016 ORDER:
The present writ petition is filed by the petitioners seeking to declare the action of the 3rd respondent in interfering with the personal life and liberty of the petitioners by calling them to the police station under the guise of alleged settlement at the instance of the 4th respondent, without following due process of law and consequently, direct the 3rd respondent not to interfere with the personal life and liberty of the petitioners without following due process of law. Heard and perused the material available on record. The grievance of the petitioners is that without there being any crime registered, the 3rd respondent is calling the petitioners to the police station and harassing them to settle the issue with the 4th respondent.
Considering the grievance of the petitioner, without going into the merits of the case, this Court is inclined to pass the following order: The Station House Officer, Godavarikhani-I Town Police Station, Godavarikhani, Karimnagar District - 3rd respondent, is directed not to harass the petitioners and not to call them to the police station, without there being any case registered against them. At the same time, this order will not stand in the way of the 3rd respondent to conduct investigation, if any complaint is registered against the petitioners for any cognizable offence.
Accordingly, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
