HON'BLE SRI JUSTICE A.RAJASHEKER REDDY Second Appeal No.467 of 2017 ORDER :

The Second Appeal is filed in the year 2002. On 28.11.2011, this Court passed order in CMP No.561 of 2005 condoning the delay of 1043 days in paying the deficit Court fee. Thereafter, the matter underwent several adjournments i.e., on 19.01.2012, 12.11.2013, 03.06.2015, 28.07.2017, 11.08.2017, 08.09.2017, 22.09.2017, 06.10.2017, 20.10.2017 and on 23.01.2018.

When the matter is listed today, it is represented by the learned counsel for the respondent that the sole appellant died and no steps have been taken for bringing the legal representatives on record.

In view of the same, the Second Appeal is dismissed as abated. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand dismissed.
