THE HON'BLE SRI JUSTICE DILIP B.BHOSALE CIVIL REVISION PETITION No.556 of 2015 P.C:
Heard learned counsel for the parties.
This C.R.P. is against the order, dated 30.12.2014, passed on an application, bearing I.A.No.2311 of 2014 in O.S.No.1895 of 2014. The order impugned reads thus:
"Issue urgent notice to respondent to furnish security to the extent of suit amount for a sum of Rs.9,54,000/- within three days from the date of receipt of notice, failing which petition schedule property shall be attached." Learned counsel for the petitioner submits that the petitioner has already filed counter and he would be satisfied if directions are given to the Court below to dispose of I.A.No.2311 of 2014 within timeframe. He further, on instructions, submits that till the next date of hearing of I.A.No.2311 of 2014, the petitioner shall not dispose of the petition schedule property. Keeping that in view and considering that interim application is still not heard and decided finally, I am satisfied that the following order shall meet the ends of justice:
"The statement made by learned counsel for the petitioner that the petitioner shall not dispose of the petition schedule property is recorded and accepted. The Court below shall consider and decide I.A.No.2311 of 2014, as expeditiously as possible, and preferably within a period of six (6) weeks from today. Learned counsel for the petitioner is directed to produce copy of this order before the Court below on or before 30.04.2015."
With these observations, the C.R.P. is disposed of. Consequently, miscellaneous petitions, if any, also stand disposed of. _____________________ DILIP B.BHOSALE,J Dt:24.04.2015 kdl
