THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.32354 OF 2016 ORDER :

It is the case of the petitioners that their father late Y.Jagannathamaiah was the owner of the land to an extent of Ac.0.35 cents in Sy.No.266A/2a and Sy.No.265/1, Rayalacheruvu Village, Yadiki Mandal, Anantapur district, having purchased by him in the year 1956 and ever since, they have been in possession and enjoyment of the said property. They are using the said land for agricultural purposes. It is stated that the respondents without resorting to any acquisition proceedings, trying to widen the road by illegally occupying the petitioners' land. Aggrieved by the same, present writ petition is filed.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

Learned Assistant Government Pleader for Revenue submits that they will follow due process of law, if they acquire the subject property.

In view of the undertaking given by the learned Assistant Government Pleader for Revenue, this writ petition is disposed of directing the respondents not to evict the petitioners, without following due process of law.

There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this writ petition, shall stands closed.
