SMT JUSTICE T.RAJANI TRANSFER CRIMINAL PETITION No.105 OF 2013 ORDER:

This Transfer Criminal Petition, under Section 407 of Cr.P.C., is filed by the Petitioner/Accused seeking to withdraw C.C. No.429 of 2012, pending on the file of the Court of XIV Special Metropolitan Magistrate, Erram Manzil, Hyderabad and transfer the same to the Court of II Special Metropolitan Magistrate, Rajendranagar to try along with C.C. Nos.260 and 263 of 2012, pending on its file.

Heard learned counsel for the petitioner and learned Public Prosecutor appearing for the 1st respondent - State. None appears on behalf of the respondents 2 and 3.

Learned counsel for the petitioner submits that the parties in all the above cases are the same, though the matters pertain to different cheques. Learned counsel also submits that already one connected case in C.C. No.564 of 2013 was withdrawn and transferred to the Court of II Special Metropolitan Magistrate, Rajendranagar by virtue of the orders of this Court in Transfer Criminal Petition No.140 of 2014, dated 28.11.2017. The order is to the effect that C.C. No.564 of 2013 pending on the file of the Court of XIX Special Magistrate, Erram Manzil, Hyderabad, was withdrawn and transferred to the Court of II Special Metropolitan Magistrate, Rajendranagar to be tried along with C.C. No.263 of 2012. 4.

Hence, considering the above, this Court opines that it would be better for all the matters to be tried by the same Court. 5.

Accordingly, with the above observation, the Transfer Criminal Petition is allowed. Consequently, C.C. No.429 of 2012, pending on the file of the Court of XIV Special Metropolitan Magistrate, Erram Manzil, Hyderabad is withdrawn and transferred to the Court of II Special Metropolitan Magistrate, Rajendranagar to try along with C.C. Nos.260 and 263 of 2012, pending on its file.

TR,J Tr.Crl.P.No.105 of 2013 6.

As a sequel, miscellaneous petitions, if any, pending in this Petition shall stand closed.
