THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CIVIL REVISION PETITION No.3765 OF 2018 ORDER:

This Civil Revision Petition, under Article 227 of the Constitution of India, is filed questioning the Order dt. 30.06.2017 in CMA No.7 of 2015 passed by V Additional District Judge, Rayachoty, filed against the Order in I.A.No.545 of 2015 in O.S.No.92 of 2015 on the file of Principal Junior Civil Judge, Rayachoty, remanding the matter to the trial Court for fresh disposal within a period of 3 to 6 months while directing both the parties to maintain status quo.

The Order impugned was passed on 30.06.2017. The contention of the learned counsel for the petitioner is that the Principal Junior Civil Judge, Rayachoty did not pass any Order inpursuance of the direction issued in I.A.No.07 of 2015 by the V Additional District Judge, Rayachoty. Though the learned counsel for the petitioner raised several contentions regarding the legality and propriety of the Order, finally requested this Court to direct the Principal Junior Civil Judge, Rayachoty, to dispose of I.A.No.545 of 2015 now pending on its file inpursuance of the directions issued by the V Addl. District Judge, Rayachoty.

Since V Additional District Judge, Rayachoty, while allowing C.M.A.No.07 of 2015 by setting aside the Order, remanded I.A.No.545 of 2015 with a direction to the Principal Junior Civil Judge, Rayachoty, to dispose of the same within a

period of 3 to 6 months. But, the Principal Junior Civil Judge, Rayachoty, did not pass any order though six months time had elapsed.

In view of the request made by the learned counsel for the petitioner, without touching the merits of the revision, I deem it appropriate to issue a direction to the Principal Junior Civil Judge, Rayachoti, to dispose of I.A.No.545 of 2015 in O.S.No.92 of 2015 on its file within a period of one month from the date of receipt of a copy of this Order.

With the above observation, this Civil Revision Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this case shall stand closed.
