HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.9193 of 2015 ORDER :

Heard the counsel for the petitioners/A-1 and A-2 in C.C.No.194 of 2013 on the file of III Special Magistrate at Erramanzil for the offences punishable under Sections 138 of Negotiable Instruments Act, outcome of report of complainant K.Prabhavathy Reddy and the learned Magistrate took cognizance of the offence punishable under Section 138 of the Act after private complaint filed and sworn statement recorded, from the material for the dishonour of cheque from cause of action issued summons at the post cognizance state. After having received the summons, the petitioners/accused failed to appear, the Court below ordered for issuing Non-bailable warrants(NBWs) and instead of approaching the Court below to recall the NBWS, the petitioners approached this Court to recall the NBWs.

Having regard to the above, this Criminal Petition is disposed of by directing the petitioners to appear before the learned Magistrate with application to recall the NBWs and the learned Magistrate shall recall the warrants on the same day subject to execution of bonds under Section 88 Cr.P.C. for the future due appearance for the due amount fixed by the learned Magistrate.

Consequently, the miscellaneous petitions, if any

pending, shall stand closed.
