Learned counsel for both parties are present and they are identified by their respective counsel. They have submitted their aadhar cards in order to prove their identity.

Heard both sides. Perused the record.

It is stated by both parties that the matrimonial dispute between the parties is settled amicably out of court and as per the terms of the joint compromise memo dated 24.11.2021, signed by both parties and the respective counsel, the marriage between the appellant and the respondent has been dissolved. It is also stated that they have entered the said compromise voluntarily and as per the terms of compromise, the appellant has to pay an amount of Rs.50 lakhs to the respondent towards permanent alimony. Out of the said amount of Rs.50 lakhs, Rs.40 lakhs has been received by the respondent. The remaining amount of Rs.10 lakhs, it is submitted, will be paid to the respondent at the time of withdrawal/closure of Section 498-A case registered against the appellant.

In view of the settlement of the matrimonial dispute between the parties amicably outside the court in terms of the compromise arrived at between them and also that the parties have agreed to

dissolve their marriage and the respondent has received the amounts due to her under the terms of settlement, divorce by mutual consent is granted in terms of the joint memorandum of compromise. 5.

In the result, the FCA is allowed, dissolving the marriage dated 22.05.2011 between the appellant and the respondent by granting a decree of divorce, in terms of the joint memorandum of compromise. The joint memorandum of compromise shall form part of the decree. No costs.
