HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.12500 of 2015 O R D E R :

The petitioner, who is accused No.1 in C.C. No.285 of 2014 on the file of the court of XIII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, for the alleged offences punishable under Sections 498-A, 506 I.P.C. read with Sections 3, 4 & 6 of Dowry Prohibition Act, filed this petition under Section 438 of Cr.P.C., seeking anticipatory bail.

The charge-sheet has already been filed in this case and the trial Court has taken cognisance of the said charge-sheet. N.B.W. is pending against the petitioner-accused No.1. Look Out Notice was also issued against the petitioner.

Considering the facts and circumstances of the case, the petitioner-accused No.1 is directed to surrender before the Magistrate concerned and file petition to recall N.B.W. issued against him. Upon filing of such petition, the trial Court is directed to recall the warrant, pending against the petitioner, on the same day on his executing a personal bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with one surety for a like sum to the satisfaction of the said Magistrate. The operation of the Look Out Notice issued by the concerned authority is hereby stayed until further orders. Further, the petitioner-accused No.1 is directed to report before the trial Court on all hearing days.
