THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.5819 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioner/A-1 in C.C.No.322 of 2015 on the file of II Additional Chief Metropolitan Magistrate at Nampally, Hyderabad arising out of Crime No.373 of 2014 of Sultan Bazar Police Station, Hyderabad, registered for the offences punishable under Sections 504 and 506 IPC.

Heard the learned counsel for the petitioner/A-1 and the learned Public Prosecutor and perused the material on record.

Admittedly, after completion of investigation into the alleged crime, the police filed charge sheet, which was numbered as C.C.No.322 of 2015. It is evident from the material on record including the charge sheet that specific overt acts are made not only against the petitioner/A-1 but also other accused, constituting the offences much less the alleged offences. Whether the petitioner/A-1 and others have committed the alleged offences or not is a matter to be adjudicated after a full fledged trial and the same cannot be decided at this stage.

Having regard to the facts and circumstances of the case and in view of the fact that specific allegations are made against the petitioner and

others, this Court is of the view that it is a not fit case to quash the proceedings invoking the jurisdiction under Section 482 Cr.P.C., and hence, the criminal petition is liable to be dismissed.

Accordingly, the criminal petition is dismissed. However, it is made clear that the learned Magistrate shall make every endeavour to dispose of the case as expeditiously as possible, preferably within a period of six months from the date of receipt of the order. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
