Heard the learned counsel for the petitioners and learned Government Pleader for Roads & Buildings for the respondents. 2.
According to the petitioners, first petitioner herein purchased an extent of 133 Square Yards of house site in R.S.No.435 in Penuganchiprolu Village on 16-06-2008 by way of Registered Sale Deed vide Document No.2571 of 2008 on the file of Sub Registrar Office, Jaggaihpet. It is further stated that the first petitioner constructed new house in the said property and is allotted D.No.4-102. It is further stated in the affidavit filed in support of the writ petition that the second petitioner herein purchased the house bearing D.No.14-65 in R.S.No.435 in 127 Square Yards in the same village by way of Registered Sale Deed No.1747 of 2009 dated 27-05-2009.

The grievance of the petitioners in the present petition is that the respondent authorities, without recourse to law, are attempting to demolish the structures for the purpose of laying a bye-pass road.

On the other hand, on instructions, it is submitted by the learned Government Pleader for Roads & Buildings that if the properties of the petitioners are required for any public purpose, the respondent authorities herein will follow the due process of law.

In view of the above, the writ petition is disposed of, directing the respondents herein not to meddle with the properties of the petitioners herein bearing D.No.4-102 & D.No.14-65 in R.S.No.435 of Penuganchiprolu Village, Krishna District. However, it is open for the respondents herein to follow the due process of law if the properties of the petitioners are required for any public purpose. No costs.
