This appeal is filed under Order 43 Rule 1 CPC assailing the orders dated 20.04.2006 in I.A.No.281 of 2006 in O.S.No.81 of 2006 on the file of the Court of Senior Civil Judge, Gajuwaka.

Heard the learned counsel for the appellants. 3.

This Court dismissed the appeal against the second respondent for default on 29.02.2016. The appeal is not maintainable without second respondent. There is no stay in this matter from 2006 onwards. No purpose would be served by keeping the matter pending.

Hence, the C.M.A. is dismissed. No order as to costs. Consequently, Miscellaneous Petitions, if any, pending in this appeal shall stand closed.
