THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6516 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. by the petitioner/A-4 seeking to quash the proceedings in Crime No.493 of 2015 on the file of Karimnagar I Town Police Station, Karimnagar District.

2. Heard and perused the material available on record.

3. The offences alleged against the petitioner are punishable under Sections 120-B, 448, 420 and 506 I.P.C. and Sections 3 and 5 of the Andhra Pradesh (Telangana Area) Money Lenders Act.

4. Learned counsel for the petitioner submitted that earlier, the petitioner was arrested in a criminal case and later, released on bail; that the case was transferred to CID Police Station and he is attending before the CID Police at Karimnagar daily; that the petitioner was in judicial remand for more than 60 days; that even after knowing about the pendency of the present crime, the police have not produced him on PT warrant before the Court concerned for remand and the police are trying to arrest him in the above case.

5. In view of the above submission, the police concerned are directed to complete the investigation and file a final report, if any, without arresting the petitioner. In the event of necessity, the police are directed to issue notice to the petitioner for his appearance before the Investigating Agency for the purpose of investigation. On issuance of such notice, the petitioner shall appear before the Investigating Agency and give an undertaking as to his future appearance as and when required by the Investigating Agency for the purpose of investigation.

6. With the above directions, the Criminal Petition is disposed of. Miscellaneous petitions pending, if any, in this Criminal Petition shall stand closed.
