THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 17499 of 2016 ORDER :

This Writ Petition is filed seeking to declare the action of respondent Nos.4 and 5 in interfering with life and liberty of the petitioner by summoning her to police station without following due process of law, as illegal and arbitrary.

2. Heard the learned counsel for the petitioner and the Assistant Government Pleader for Home for the State of Andhra Pradesh appearing for respondents 1 to

5. At the request of both the counsel, the Writ Petition itself is taken up for disposal at the stage of admission.

3. The case of the petitioner is that she is widow of one Sk.Babu, who died in a motor vehicle accident on 24.05.2011 and from the date of his death, she, along with her three children, have been residing with her parents-inlaw, who are looking after her with love and affection. It is her grievance that unofficial respondents 6 and 7, who are her parents, with an intention to grab the compensation that she may receive on account of death of her husband in the road accident, are making every effort to perform the another marriage to her with one retired employee. It is stated that when she refused, unofficial respondents 6 to 9 lodged a false report with police stating as if she

eloped with somebody and residing elsewhere without the knowledge and consent of the parents. It is her case that she voluntarily came to her parents-in-laws' house along with her children. It is also said that in pursuance of the report, respondent No.5 is frequently calling her to police station on phone and asking her to appear.

Learned Assistant Government Pleader appearing for respondents 1 to 5, on instructions, stated that respondent Nos. 4 and 5 are not interfering with life and liberty of the petitioner and they are discharging their legitimate duties as per law. Recording the said submission, the Writ Petition is disposed of making it clear that the respondents shall follow due process of law while summoning the petitioner to the police station for examination.

5. Miscellaneous petitions pending, if any, in the Writ Petition shall stand closed in the light of this final order. No order as to costs.
