THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.8488 of 2015 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C seeking to relax the condition imposed by the learned Special Judge for trial of offences under the S.Cs. and S.Ts. (PoA) Act, 1989-cum-V Additional Sessions Judge, Nellore, i.e., "the petitioner shall not leave India without prior permission of the Court"

The petitioner preferred Crl.M.P.No.117 of 2015 before the Special Judge for trial of offences under the S.Cs. and S.Ts. (PoA) Act, 1989-cum-V Additional Sessions Judge, Nellore under Section 438 Cr.P.C. seeking relaxation of conditions imposed against him by the Court in Crl.M.P.No.18 of 2015, dated 24-03-2015, without producing any documents. Hence, the Court below dismissed the application.

The learned counsel for the petitioner submits that due to some misunderstanding, the petitioner could not substantiate his case for leaving India and could not produce the documents to show that he intends to travel abroad.

Considering the facts and circumstances of the case, the condition imposed by the trial Court that the petitioner should seek permission of the trial Court for leaving India to travel abroad is hereby set aside and the petitioner is at liberty to travel abroad.

Accordingly, the Criminal Petition is disposed of.
