THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40748 OF 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the second respondent in not investigating into the complaint filed by the petitioner, which was registered as F.I.R.No.395 of 2016 for the offences under Sections 420, 406, 348, 506 read with 34 IPC and Section 3(1)(r)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act as illegal and arbitrary, and consequently to direct the second respondent to investigate into the said crime.

Heard and perused the material.

Learned counsel for the petitioner submits that though the complaint lodged by the petitioner is registered being F.I.R.No.395 of 2016, the second respondent is not investigating into the case at the behest of the respondents 3 to 7. Hence, he prays this Court to direct the second respondent to complete investigation as early as possible. Considering the facts and circumstances of the case, the second respondent is directed to complete the investigation and file final report, if any, in accordance with law, as expeditiously as possible.
