HON'BLE SRI JUSTICE T. AMARNATH GOUD CRIMINAL PETITION No.6901 of 2011 ORDER:

This criminal petition is filed under Section 482 Cr.P.C., seeking to quash the proceedings against the petitioner in FIR No.41 of 2011 dated 14.07.2011 on the file of the P.S., Kakumanu, Guntur District, registered for the offences under Sections 384 and 506 IPC. The 2nd respondent is the complainant and she is the grandmother of the petitioner/accused. Several allegations are made by the complainant against the petitioner, which need to be enquired and since the case is at the FIR stage and needs investigation, the criminal petition is accordingly dismissed, directing the prosecution to follow the procedure under Section 41-A Cr.P.C. Till investigation is completed and charge sheet is filed, the petitioner shall not be arrested. The petitioner shall cooperate with the investigation. As a sequel, miscellaneous petitions if any pending stand closed.
