As there was no representation for the appellant on 29.06.2016, the matter was directed to be listed next week under the caption "FOR DISMISSAL".

2. Even today, despite the matter being listed under the caption "FOR DISMISSAL", there is no representation for the appellant. It appears that the appellant is not interested in pursuing the matter. 3.

Learned counsel for the 1st respondent/claimant, while submitting that this Court dismissed MACMA.No.774 of 2005, by order dated 07.12.2012, preferred by the Insurance Company, which claim relates to the injuries sustained by the petitioner therein in the very same accident, placed on record a copy of the said judgment.

Even otherwise, since there is no representation for the appellant, the Civil Miscellaneous Appeal is dismissed for nonprosecution.
