SMT. JUSTICE T. RAJANI CRIMINAL PETITION NO. 12306 OF 2011 O R D E R :

This Criminal Petition is filed seeking quash of the F.I.R. in Crime No. 191 of 2011 registered by the Station House Officer, Lungarhouz Police Station, Hyderabad, which was referred by the VI-Additional Chief Metropolitan Magistrate, Nampally, Hyderabad against the petitioner for the offence punishable under section 406, 420, 120-B of I.P.C.

2. On 30/1/2011 this Criminal Petition was admitted by this Court and in Crl.PMP.No. 13893 of 2011 interim stay was granted. On 11/10/2017 it was represented on behalf of the third respondent that the investigation is completed and charge sheet is filed. However, learned Public Prosecutor contends that the crime is still under investigation. To verify and report, the matter was adjourned to 20/10/2017.

3. On 25/7/2018 learned counsel for respondent No.3 would submit that there is a likelihood of this matter being compromised and requested time to ascertain from the party and the matter was adjourned to 02/8/2018.

4. On 02/8/2018 there was no representation for the petitioner, the matter was directed to be listed after two weeks.

5. On 16/8/2018 none appears for the petitioner, the matter was adjourned to 23/8/2018 under the caption "for dismissal".

6. Today, i.e., 23/8/2018, when the matter is listed under the caption "for dismissal", none appears for the petitioner and there is no representation on behalf of the petitioner. Hence, this Court opines that the petitioner is not diligent while prosecuting the case, since the matter is adjourned from time to time.

7. In the result, this Criminal Petition is dismissed for nonprosecution. The order dated 30/11/2011 passed by this Court in Crl.PMP.No. 13893 of 2011 shall stand dissolved.

8. As a sequel, miscellaneous petitions if any, pending in this Criminal Petition shall stand disposed of.
