THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO W.P No.26464 of 2016 ORDER: (per the Hon'ble SRI JUSTICE SURESH KUMAR KAIT) Vide the present petition, the petitioner seeks direction thereby directing the respondents No.2 and 3 to produce and safeguard the person of petitioner's mother namely Patnala Jaya Laxmi, aged about 56 years, from the custody of respondent No.4 before this Court and safeguard her interest and consequently to direct the respondents No.1 to 3 to take measures for protection of her life and liberty. Pursuant to notice issued to the respondents, the respondent No.3-Station House Officer, Pendurthi Police Station, Visakhapatnam District, has filed the counter affidavit, whereby stated that, based on the complaint, a case in Crime No.

18 of 2014 under head "Woman Missing" was registered on 13.01.2014 for an incident that occurred prior to 09-01-2014 at Pendurthi Police Station, Visakhapatnam City. Thereafter, they investigated the case and also interrogated respondent No.4-Patnala Suseela Madhuri Devi, who has stated that, on 11.01.2014, the petitioner informed her over phone about the missing of her mother-in-law and enquired the whereabouts of the Missing Woman.

Accordingly, she told the petitioner that she does not know the whereabouts of her mother-in-law. She further stated

that, she informed her husband Narayana Rao over phone about the missing of his mother.

She further stated that during the life time of her fatherin-law, there were disputes between the petitioner and her husband Bangar Raju and said Bangar Raju used to beat Padma, the petitioner herein, and sent her to her parents' house. After the death of her father-in-law, Bangar Raju took away the death benefits of her father-in-law and thereafter he used to look after her well.

She further stated that, her father-in-law is having Ac.0.20 cents of land at Narava village and the same was sold to some S.T. people and the said matter was not known to Bangar Raju. She expressed suspicion against the petitioner's husband A. Bangar Raju for the missing of her mother-in-law. Furthermore, her mother-in-law is having bank accounts in Andhra Bank, State Bank of India and Cooperative Bank and was drawing pension. The mother of the petitioner was missing since 09.01.2014. The respondent No.3 has made all efforts but could not trace her out. The respondent No.3 has assured this Court that as and when any information is received the same shall be conveyed to the petitioner.

In view of the facts recorded above, the Writ Petition is closed. There shall be no order as to costs.

We hereby make it clear that if any information is received by the respondent No.3, the same shall be communicated in writing to the petitioner.

Pending miscellaneous petitions, if any, shall stand closed.
