THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.11904 of 2016 ORDER:
Petitioner contends that the 6th respondent is alienating the property which had been gifted by one Singari Sanjuanma in favour of the Padmasale Community in 1973 and that in spite of complaint being made to the 2nd respondent, no action has been taken in that regard.
2. It is not disputed by the counsel for petitioner that trust in question is a private trust which is not covered under the Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1987.
3. When the properties of the said trust do not fall within the prohibited category under Section 22A of the Registration Act, 1908, petitioner cannot compel the respondents 3 and 4 not to register any document in relation to the said trust by the 6th respondent.
4. Therefore, this Writ Petition is without any merits and it is accordingly dismissed.
However, this will not preclude the petitioner to avail other remedy available to it under any statute before the appropriate forum. There shall be no order as to costs.
5. Consequently, the miscellaneous petitions, if any pending, shall stand closed.
