THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.21901 OF 2016 ORDER:

Heard the learned counsel for the petitioners and the learned Government Pleader for Home. With the consent of the counsel appearing for both parties, the present Writ Petition is disposed of at the admission stage.

Since this Court is not adjudicating the matter on merits, hearing of the unofficial respondent may not be necessary. 2 . The present writ petition came to be filed with the following prayer:

"to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondent Nos.2 to 4 in calling the petitioner to their office frequently, without there being any complaint against the petitioners is illegal, arbitrary and violation of Article 14 and 19(1)(g) of the Constitution of India, consequently direct the Respondents Nos.2 to 4 not to call the petitioners to the Office and Police Station, forthwith, and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

3. The grievance of the petitioners appears to be that respondents 2 to 4 are illegally and intentionally calling them to the police station to settle the civil dispute pending between them and the unofficial respondent.

4. Learned Government Pleader for Home submits that allegations made in the writ petition are all false and if the petitioners are to be summoned to the police station, respondents will follow the due process of law.

5. Having regard to the above, the Writ Petition is disposed of

directing the respondents-police to be mindful of the limits of their jurisdiction in criminal law and not to interfere with any civil dispute pending between the petitioners and the unofficial respondent. Needless to mention that the respondents shall follow due process of law while summoning the petitioners to the police station or arresting them in the event of a crime being registered against them.

Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
