THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.12411 OF 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:

"to issue an appropriate writ, or order or direction more particularly one in the nature of writ of Mandamus declaring the action of the Respondents in not permitting the representatives of petitioners Union in the counselling for the revision of Duty Charts commenced from 07.04.2016 is unjust, arbitrary, contrary to Section 33 of the Industrial Disputes Act, 1947 and the provisions of Trade Unions Act, 1926, discriminatory and in violation of Article 14 and Article 21 of the Constitution of India and consequently direct the Respondents to permit the representatives of the petitioners Union in the ongoing counselling before finalizing the revision Duty Charts in 3rd Respondent Depot, in the interest of justice and fair play and pass such other order or orders just and necessary in the circumstances of the case."

2. Heard Sri A.G.Satyanarayana Rao, learned counsel, appearing for the petitioners and Sri A.Rama Rao, learned standing counsel, appearing for the respondents.

When the matter is taken up, it is represented by the learned counsel for the petitioners that for redressal of the grievance of the petitioners, petitioners herein submitted a representation dated 05.04.2016 to the 3rd respondent herein and no orders have been passed on the said representation so far and a copy of the same is also placed on record. It is further requested by the learned counsel that necessary direction may be issued to the respondent to pass appropriate orders on the said representation, in accordance with law, by fixing some timeframe.

4. Recording the said submission and having regard to the nature of controversy, Writ Petition is disposed of, without expressing any opinion on the merits and demerits of the matter and entitlement of the petitioners, directing the 3rd respondent herein to consider and pass appropriate orders on the representation dated 05.04.2016 said to have been submitted by the petitioners herein, in accordance with law, within a period of one week from the date of receipt of a copy of this order.
