Heard.

The relief sought for by the petitioner restraining the 2nd respondent from entertaining any claim for mutation on the face of it is not maintainable, as such a relief restraining the 2nd respondent from discharging his statutory duties cannot be granted by way of Mandamus. The petitioner appears to be interested in objecting to the claim for mutation and the petitioner states that he is the son of the deceased and he is entitled for mutation of his name in the revenue records and accordingly issued Ex.P-2-legal notice to the 2nd respondent not to entertain any request or mutate the name of anybody including his mother and sister.

As stated above, the relief sought for cannot be granted. However, if the petitioner seeks to object to any request made by anybody for mutation of name in the revenue records, it is open for him to file objections before the 2nd respondent, so that the 2nd respondent would be in a position to consider the application for mutation as well as the objections and then pass appropriate orders in accordance with law.

Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
