HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36396 OF 2016 ORDER:

The present writ petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking to issue a writ of mandamus declaring the action of the respondents 2 and 3 for not investigating into Crime No.73 of 2015, registered against respondents 4 & 5, on the basis of the complaint made by the petitioner.

The main grievance of the petitioner is that the complaint filed by him before the VI Additional Junior Civil Judge cum Judicial Magistrate of First Class, Guntur, against the respondents 4 & 5, who trespassed into his house along with their family and staying there, was referred to the 2nd respondent. But the police did not choose to conduct investigation.

Heard and perused the material available on record. Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, respondents Nos.2 and 3 are directed to conduct investigation in the above crime, complete the same and file a final report, as expeditiously as possible, and file final report, if any.

With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
