CVNR, J & GSP, J WP.No.19145 of 2018 Dt: 19.06.2018 Order: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Writ Petition is filed for a Habeas Corpus for production of the petitioner's daughter- Kotla Kavitha (for short 'the alleged detenue') before this Court and setting her free.
In pursuance of the direction issued by this Court on 12.06.2018, respondent No.5- Sub-Inspector of Police, Vangoor Police Station, Nagar Kurnool District, has produced before this Court, the alleged detenue and respondent No.4, whom she is stated to have married. The petitioner and her husband are also personally present. In their presence, the alleged detenue informed that she has voluntarily married respondent No.4 and that she is living happily with him. When the petitioner and her husband requested the alleged detenue to join them for spending a few days with them, the alleged detenue has bluntly declined their request and requested the Court to allow her to live with respondent No.4.
In the light of the view expressed by the alleged detenue, who is, admittedly, a major, the prayer in this Writ Petition cannot be granted.
