THE HON'BLE SRI JUSTICE S.V.BHATT W.P. No.5562 of 2007 ORDER:

The petitioner is represented by the then Sarpanch Mr.G.Rama Chandra. The petitioner challenges the telegraphic communication dated 07.12.2006 of the 2nd respondent. Through the telegraphic order dated 07.12.2006, the 2nd respondent has kept in abeyance, the proceedings dated 15.09.2006. On 12.04.2007, this Court granted interim direction and further left it open to District Collector/1st respondent to take action in accordance with law.

Mr.Srinath Reddy appearing for petitioner submits that the challenge in the writ petition is against a telegraphic order and the Gram Panchayat may be given liberty to file representation before the 1st and 2nd respondents. If the issue is still alive, the 1st and 2nd respondents may be directed to consider the reply and pass orders.

The statement is placed on record.

Writ petition is accordingly disposed of:

"Sundupalli Gram Panchayat is given liberty to represent to 1st and 2nd respondents against

telegraphic order dated 07.12.2006 by enclosing a copy of this order within six (06) weeks from today. The 1st and 2nd respondents if have not taken a decision during pendency of the writ petition are directed to expeditiously consider the reply of Gram Panchayat and pass orders. No order as to costs." Miscellaneous petitions, if any, pending, shall stand closed.
