HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.31694 OF 2017 ORDER:

The case of the petitioner is that he was provisionally selected for the post of SCTPC TSSP under OC category in 13th Battalion, TSSP(IR) Mancherial (Selected Unit) vide Registration No.236024 and thereafter, he was issued show-cause notice dated 17-05-2017 stating that he is involved in two criminal cases. On that the petitioner submitted explanation on 18-05-2017, but no orders are passed. Aggrieved by the same, the present writ petition is filed.

Learned counsel for the petitioner says that suppression of fact is neither willful nor wanton. Since the petitioner was deleted from array of accused in the charge sheet, he has not mentioned the same in the on-line application form. Heard learned Government Pleader for Services, who says that the petitioner's name is very much available at the time of registration of crime, that itself is sufficient for disqualifying for the post.

It is to be seen that rival contentions of the petitioner as well as Government Pleader have to be considered by competent authority. Already show-cause notice was issued and explanation is filed. Normally, this Court will not interfere at the stage of show-cause notice and it is not the case of the petitioner that show-cause notice is without jurisdiction. In view of the same, the competent authority is directed to consider the explanation of the petitioner and pass

appropriate orders in accordance with law within a period of four weeks from the date of receipt of a copy of this order and take action accordingly.

With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 18-09-2017 Note:
