HONOURABLE SRI JUSTICE GUDISEVA SHYAM PRASAD WRIT PETITION No. 1617 OF 2016 O R D E R :

This writ petition is filed seeking a writ in the nature of Certiorari to quash the complaint registered by the third respondent in Crime No. 393 of 2015 for the offences punishable under section 406, 417, 420 read with section 34 of IPC and Section 7 of Essential Commodities Act and 17 [a] of PDS Act Control Order, 2008 and 3 [r] and 3 [A] of the MS & HSD [Regulation of Supply and Distribution & Prevention of Malpractice] Order, 1998 dated 17/12/2015 of Shameerpet Police Station, Cyberabad, Hyderabad district basing on the false complaint lodged by respondent No.4.

2. The learned counsel for the petitioners is not present and there is no representation on behalf of the petitioners. This writ petition is filed in the year 2016 and the investigation is said to have been completed and the learned Assistant Government Pleader submits that the charge sheet has been filed and the case is numbered as C.C.No. 1482 of 2017 on the file of XXI Metropolitan Magistrate, Medchal, Cyberabad, and therefore, the relief claimed in this writ petition has become infructuous, as the petitioners have sought for quashing of FIR.No. 393 of 2015.

3. Recording the above submission, this writ petition is dismissed as infructuous. No costs. The petitioners may agitate their rights, if they are advised to do so.

4. As a sequel, miscellaneous petitions if any, pending in this writ petition shall stand closed.
