THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT APPEAL No. 51 of 2015 JUDGMENT: (Per the Hon'ble The Chief Justice Sri Kalyan Jyoti Sengupta) The writ petitioner-appellant filed the writ petition for setting aside the final order of assessment passed by the 2nd respondent in proceedings dated 25.08.2003.
The learned Trial Judge has noted that on 13.09.2007 the writ petitioner was asked to deposit an amount of Rs.1,50,000/- out of the demand of Rs.4,30,933/-. However, the writ petitioner also did not pay the aforesaid amount and the learned Trial Judge recorded that the impugned order in the writ petition dated 04.07.2007 was passed by the 1st respondent after giving an opportunity of personal hearing and even the petitioner did not raise any dispute as to his liability to pay during the personal hearing. Under these circumstances, the learned Trial Judge found that no relief should be granted.
In view of the aforestated appreciation of the fact, we are unable to entertain this appeal and the same is accordingly dismissed having found no merit in it.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
