THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CONTEMPT CASE NO.699 OF 2013 ORDER:

This Contempt Case is filed under Sections 10 to 12 of the Contempt of Courts Act, 1971 to punish the respondent/contemnor for willfully and wantonly violating the order of this Court, dated 12-10-2012 in A.S.M.P.No.621 of 2009 in A.S.No.535 of 2008. 2.

Heard learned counsel appearing for both parties. Perused the statements of account filed by the counsel. 3.

The fact that emerges is that as on 26-12-2016, an amount of Rs.2,16,000/- is payable, but whereas proof of payment of an amount of Rs.1,57,500/-by way of challans on various dates have been produced. According to the learned counsel for the petitioner, the alleged contemnor is yet to pay an amount of Rs.22,500/-.

Learned counsel for the petitioner submits that if that amount is also paid, arrears till date will be cleared and hence, the respondent may be directed to pay the same and with that direction, the contempt case may be closed.

In view of the same, the Contempt Case is closed with a direction to the respondent/4th defendant to clear off the arrears after making proper calculation within a period of one month from today and also continue to comply with the order in future without any default.
