B. Raghunath v. The State Of Andhra Pradesh
THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.17338 of 2017 ORDER :
The petitioner challenges the action of the respondents in not continuing him in service till he attains the age of superannuation of 60 years with all consequential benefits. Learned counsel for the 2nd respondent-Corporation submits that earlier the petitioner along with others filed WP.No.14795 of 2017 in respect of the same relief and this Court refused to grant interim order in WPMP.No.18303 of 2017 in W.P.No.14795 of 2017, dated 26.04.2017. The said fact is not disputed by learned counsel for the petitioner. Learned counsel for the petitioner also submits that subsequently on 05-05-2017 in SLP(C) No.14699-14702 of 2017 the Apex Court has granted orders in favour of the petitioner therein and similarly situated persons. Once the petitioner has filed W.P.No.14795 of 2017 and when interim order is declined, the petitioner cannot file another writ petition with similar relief. If the petitioner feels aggrieved by the order passed by this Court in WPMP.No.18303 of 2017 in WP.No.14795 of 2017, he could have challenged the same.
In view of the same, this writ petition is dismissed.
ARR,J W.P.No.17338 of 2017 As a sequel, miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
