HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.7861 of 2017 ORDER:

Heard learned counsel for petitioners/ accused Nos.4 & 5 of Crime No.164 of 2017 of PS Yellandu, Khammam District, registered for the offence punishable under Section 376 IPC and also learned pubic prosecutor representing the 1st respondentState. 2) Learned Public Prosecutor submits that the police already filed charge sheet.

3) Having regard to the above, the Criminal Petition is closed with liberty to file fresh Criminal petition impugning the police final report with part-II CD. Needless to say, the petitioners are at liberty to file the petition under Rule 37 of Criminal Rules of Practice for one to represent others, if at all, it is for the trial Court to consider.

4) Pending miscellaneous petitions, if any, in this Criminal Petition shall stand closed.
