THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 21298 of 2016 ORDER :
The present Writ Petition came to be filed seeking to issue writ of mandamus declaring the action of respondent Nos. 2 and 3 in interfering with personal liberty of petitioners by calling them to police station and harassing them without there being any registration of crime against them, as illegal and arbitrary.
2. Heard the learned counsel for the petitioners and the Assistant Government Pleader for Home for the State of Andhra Pradesh appearing for the respondents. At the request of both the counsel, the Writ Petition itself is taken up for disposal at the stage of admission. Since this court is not adjudicating the case on merits, it may not be necessary to hear unofficial respondent No.4.
3. Case of the petitioners is that engagement ceremony of petitioner No.1 with respondent No.4 took place on 10.10.2015, but, later, mother of respondent No.4 informed petitioners that respondent No.4 is not interested to marry petitioner No.1 and demanded to pay an amount of Rs.3,00,000/- incurred by her for the engagement ceremony. It is their grievance that at the instance of respondent No.4 and her mother, respondents 2 and 3 are calling the petitioners to police station and
pressurizing them to settle the dispute with them by paying the amount.

Learned Assistant Government Pleader appearing for respondents, on instructions, stated that respondent Nos. 2 and 3 are not summoning the petitioners to the police station and if their attendance is required, they would follow due process of law. Recording the said statement and having regard to the fact that no crime is pending against the petitioners as on today, the respondents are directed not to summon the petitioner to police station without following due process established by law.
5. The Writ Petition is disposed of with the aforesaid direction. Miscellaneous petitions pending, if any, in the Writ Petition shall stand closed in the light of this final order. No order as to costs.
