Petitioner while working as village servant order of dismissal from service was passed based on his conviction by the trial Court. On appeal the conviction was affirmed. However, in Crl.R.C.No.445 of 2005, this Court acquitted the petitioner of the charges levelled. After his exoneration petitioner submitted representation to restore him to service by setting aside the order of dismissal from service. Alleging that the said representation is not acted upon, this writ petition is filed.

Having regard to the fact that the representation is already made by the petitioner seeking to review the earlier decision of dismissal as a consequence to the order of High Court in Crl.R.C.No.445 of 2005, this Court is not inclined to entertain the writ petition and keep the writ petition pending. 4.

Accordingly, the Writ Petition is disposed of directing the Mandal Revenue Officer, Achampet Mandal, Nagarkurnool District (3rd respondent) to examine the representation of the petitioner by taking into consideration the exoneration granted to him in Crl.R.C.No.445 of 2005, pass orders and communicate the same to the petitioner. A decision to this effect shall be made and communicated within a period of two (2) months from the date of receipt of copy of this order. There shall be no order as to costs.

Miscellaneous petitions, pending if any, in this writ petition shall stand closed.
