HON'BLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION No.22331 OF 2019 ORDER:

This writ petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking the following relief: "For the reasons stated in the accompanying affidavit, it is therefore prayed that this Hon'ble Court may be pleased to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus, declaring the action of the 2nd respondent in not considering the representation dated 26.09.2019 of the petitioner requesting not to grant any permissions with regard to the petitioner land to an extent of Ac.2.15 gts in Sy No. 965/B situated at Hanmakonda Revenue Village, Warangal Urban District basing on the Injunction Order passed in IA No. 240/2013 in OS No. 170/2013 dated 12.03.2013 on the file of Principal Senior Civil Judge, Warangal and also not considered the application No. CP.13507/2013, dated 02.

04.2013 is illegal, arbitrary and against the principles of natural justice and also violative of the Articles 14, 19, 21 and 300-A of Constitution of India and consequently direct the respondents to consider the representation dated 26.09.2019 of the petitioner in the interest of justice and to pass such other order or orders in the interest of justice."

Heard Sri M.Ajay Kumar, learned counsel appearing for the petitioner, learned Government Pleader for Municipal Administration appearing for the 1st respondent and Smt Pingali Lakshmi, learned standing counsel appearing for respondents 2 to 4.

The main grievance of the petitioner is that the petitioner has submitted a representation, dated 26.09.2019, to the 2nd respondent requesting not to grant any permissions with regard to the petitioner's agricultural lands in Survey No.965/8,

TA, J W.P.No.22331 of 2019 admeasuring to an extent of Ac. 2.15 guntas, situated at Hanmakonda Revenue Village, Warangal Urban District, basing on the Injunction Order passed in IA.No.240 of 2013 in O.S.No.170 of 2013, dated 13.03.2013, on the file of the Principal Senior Civil Judge, Warangal, and the same is not considered by the respondents.

Having regard to the facts and circumstances of the case and without expressing any opinion on merits, the Writ Petition is disposed of directing the respondents to consider the representation of the petitioner, dated 26.09.2019, in accordance with law, and pass appropriate orders, as expeditiously as possible, preferably within a period of four (04) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
