THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.17507 OF 2016 ORDER:

Heard learned counsel for the petitioners, learned Government Pleader for Panchayat Raj appearing for respondents 1 to 3, and Sri G. Seshadri, learned Standing Counsel appearing for the 4th respondent. The petitioners state that the 5th respondent constructed a small bathroom on public way which is obstructing the ingress and aggress of the petitioners and villagers, particularly the movement of cattle, tractors etc. The petitioners' further state that the 5th respondent did not cooperate for laying water pipeline in front of his house and he and his family members have political connections. The grievance of the petitioners is that though they made number of complaints to Mandal Tahsildar and Mandal Development Officer on 20.10.2014, 10.11.2014 and 17.11.2014, including the one eternal complaint dated 05.01.

2015 to the District Collector, YSR District, the 2nd respondent, no action has been taken thereon. Learned counsel for the petitioners seeks a direction to the 2nd respondent to take into consideration the complaints made by the petitioners and other villagers and act on the same in accordance with law. He further states that the construction made by the 5th respondent is without any permission as required under the Andhra Pradesh Panchayat Raj Act (for short, 'the Act'). In view of the same, the respondent authorities are directed to take into consideration the complaints made by the petitioners on various occasions and pass appropriate orders in accordance with law.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in the Writ Petition shall stand closed.
