THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39403 of 2016 ORDER:
This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of the 3rd respondent in registering Crime No.318 of 2016 against the petitioners, as illegal and arbitrary. The case of the petitioners is that the 1st petitioner is the husband of the 4th respondent, 2nd petitioner is brother-in-law of the 1st petitioner, 3rd petitioner is the father of the 1st petitioner and 4th petitioner is the sister of the 1st petitioner. The 4th respondent lodged the present complaint alleging that the 1st petitioner along with his family members used to harass the 4th respondent physically and mentally for additional dowry and on 26.09.2016, the 1st petitioner pushed the 4th respondent and she got fractured her leg.
The main grievance of the petitioners is that the 2nd respondent, at the instance of the 4th respondent, implicated the names of the petitioners in the present crime without any basis. Considering the grievance of the petitioners, the 3rd respondent is directed to complete the investigation in Crime No.318 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioners. Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed.
