HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.19237 of 2018 ORDER:

This writ petition is filed alleging that the respondents 2 to 4 are not mutating the name of the petitioner in online revenue records and not issuing E-Patta passbooks in respect of land to an extent of Ac.1-00 cents in Sy.No.50/1C situated at Mamidalapadu village fields, Kurnool Mandal, Kurnool District, inspite of application being made by the petitioner under form VI-A dated 2011-2017.

Counter affidavit is filed by respondent No.4 stating that application of the petitioner dated 20-11-2017 is rejected on 27-11-2017 and a copy of Meeseva report is produced, wherein in remarks column it is mentioned as "Rejected". Except that, no separate order has been enclosed along with counter affidavit by giving reasons for rejection. On that sole ground, rejection order is to be set aside. Though in the counter affidavit other aspects are stated, the rejection order has not been supported by any reasons and reasons cannot be supplemented by way of counter affidavit. (Mohinder Singh Gill V. Chief Election Commissioner ٱ (1978) 1 SCC 405.) In view of the same, the order of rejection is set aside and the 4th respondent is directed to reconsider the application of the petitioner after giving him an opportunity of hearing and after taking into account, the objections raised in the counter affidavit.

Accordingly, the writ petition is disposed of.

There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
