29.11.2021 LK, J On being mentioned By order dated 16.11.2021, pre-arrest bail was granted to petitioners - accused.

However, on being mentioned, when this Petition came up before this Court on 19.11.2021, it is submitted by learned counsel for petitioners that though petitioners are ready to execute the bonds, police stated that they would not accept the bail bonds unless petitioner No.1 is brought before them. It is also submitted that police locked the premises of petitioners and affixed notices mentioning 'property under dispute' and 'selling and dealings are prohibited'. In that regard, petitioners were directed to file an affidavit and counter to the same by the officer concerned.

Petitioners filed an affidavit reiterating their contentions and a counter was also filed by the police officer denying all these facts. In the counter, it is also stated that police officer has nothing to do with any of those allegations and they have not locked the premises.

In view of the affidavit and counteraffidavit, it is left open to petitioners to avail appropriate remedies under law against the officer concerned, if they are advised to do so. Accordingly, Petition is closed.
