This Writ Petition is filed for a Mandamus to declare the action of respondent No.1 in passing the impugned order, dated 24.03.2009, in Rc.No.K4/PKD/26/2009, staying the operation of the order of respondent No.2 in Rc.No.771/2008, dated 30.06.2008, as illegal and arbitrary. The petitioner also sought for a consequential direction to set aside the order of respondent No.1.

Counsel for the petitioner, submitted that the cause in this Writ Petition does not survive for adjudication and that the Writ Petition has become infructuous. The above-submission of the learned Counsel for the petitioner is placed on record and the Writ Petition is, accordingly, dismissed as infructuous.
