HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.19240 of 2018 ORDER:

Heard learned counsel appearing for parties.

The petitioner prays for the following relief :- " .....issue a writ of certiorari call for the records pertaining to the order dated 04.05.2018 in case no I/ 2239/ 2017 passed by the Revenue Divisional Officer, Jangaon, the second respondent herein in respect of land admeasuring Ac.0-30 guntas in survey number 530/ A of Tharigoppula Village and Mandal, Jangaon District, erstwhile Warangal District and quash the same....." .

The Assistant Government Pleader objects to the maintainability of writ petition on the ground that the petitioner has remedy of revision as laid down by this Court in KURUVA HA NUM A NTHA M M A Vs.

PRINC IPA L SEC RETA RY, REVENUE DEPA RTM ENT, HYDERA BA D A ND A NO THER 1 and without availing the remedy of revision filed the instant writ petition under Article 226 of the Constitution of India and the same is not maintainable. After perusing the prayer and the averments in the affidavit, this Court is of the view that the remedy of revision is available to petitioner as well as 5th respondent. 1 2017 (6) ALT 449

Hence, by giving liberty to pursue one or the other remedies as is available in the fact situation of the case, the writ petition is dismissed. No order as to costs. Miscellaneous petitions, if any, pending, shall stand closed. _____________ S. V. BHATT, J Dt: 13-06-2017 Prv
