HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.25527 of 2011 ORDER:

This writ petition was filed challenging the action of the respondents in seeking to acquire the land of the petitioner admeasuring Ac.0.53 in Sy.No.97-2 and Ac.0.27 in Sy.No.96-1 of B.N.Halli village, Rayadurg Mandal, Anantapur District, vide notification under Section 4 (1) of the Land Acquisition Act dated 29.10.2010.

Though the writ petition was admitted on 14.09.2011, no interim stay was granted. As a result of which, the further proceedings have been taken and an award was passed. The petitioner was awarded an amount of Rs.56,700/- and Rs.1,11,300/- and the same was paid to him on 29.09.2011. The petitioner received the said amount without any protest. It appears that the petitioner further stated that the railway track was passing through his land and he has no objection for the present alignment of the railway line. Though the writ petition was filed for change of alignment of the railway line in the year 2011, in view of the subsequent developments as aforesaid, the writ petition has become infructuous and no further orders are required to be passed in the present writ petition.

The Writ Petition is accordingly dismissed as infructuous. No order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
