Ghantasala Sivarama Krishna Gupta v. Station House Officer,
THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.23792 OF 2011 DATED: 08.06.2015 Between:
Ghantasala Sivarama Krishna Gupta .. Petitioner And Station House Officer, I Town Police Station, Gudivada, Krishna District.
.. Respondent THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.23792 of 2011 ORDER:
The grievance of the petitioner was that the Station House Officer, I Town Police Station, Gudivada, Krishna District, was calling him and visiting his house at odd hours thereby curtailing his right to life. The Sub-Inspector of Police, I Town Police Station, Gudivada, filed a counteraffidavit stating that there was no interference by the police with the life and liberty of the petitioner. Reference was made to the complaint lodged by the petitioner's daughter against the petitioner upon which an entry was made in the general diary but, as the same did not disclose any offence, no case was stated to have been registered. Reference was also made to the civil disputes pending between the
petitioner and his wife and the complaint lodged by the petitioner against his wife, which was registered as Crime No.149 of 2010 and was closed after investigation. Reference was also made to the divorce petition filed by the petitioner against his wife in O.P.No.77 of 2009. The Sub-Inspector categorically denied the allegation of the petitioner that the police were calling the petitioner or visiting his house at odd hours and threatening him. In the light of the unequivocal stand of the police authorities as set out in the above counter-affidavit, no cause is made out for interference by this Court. Duly taking on record the said stand, the writ petition is closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
