THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 8626 of 2017 ORDER:
This writ petition was filed challenging the action of respondent No.3-Station House Officer, Parawada Police Station, Visakhapatnam in calling petitioner No.1 to the Police Station without registering any crime and trying to settle the disputes between the petitioners and respondent No.4.
Learned Government Pleader for Home, on the basis of written instructions, submits that respondent No.4 approached the Police on 18.12.2016 alleging that petitioner No.1 who is her husband used to harass and neglect her. Based on the said complaint, an entry was made in the General Diary and that respondent No.4 and petitioner No.1 were enquired and that petitioner No.1 informed the Police that he would resolve the matter in the presence of village elders and therefore, he was not called to the Police Station. However, a case in Crime No.47 of 2017 was registered on 15.03.2017 for the offences punishable under Sections 498-A, 494 and 506 IPC read with Section 34 IPC and Section 3 of the Dowry Prohibition Act and the investigation is under progress. Respondent No.3 is not interfering with the civil disputes, as alleged by the petitioners.
In view of the above, no further orders are necessary in the present writ petition.
The writ petition is accordingly closed.
