O R D E R

The writ petition came to be filed for the following relief: "For a writ of mandamus declaring the action of the respondents in not providing police protection and completing the investigation in Crime No.130 of 2017 dated 24.4.2017 of the 3rd respondent, as illegal, arbitrary and contrary to the fundamental principles enshrined in the Constitution of India and consequently direct the respondents 2 and 3 to provide police protection to the petitioner and direct the 3rd respondent to complete the investigation expeditiously in Crime No.130 of 2017 dated 24.4.2017 and pass such other order or orders as this court deems fit and proper in the circumstances of the case."

The learned counsel for the petitioner submits that a case in crime FIR.No.130/2017 on the file of 3rd respondent came to be registered against one Saibab, Mastanamma and her daughter on the report of the petitioner and that they are threatening the petitioner with dire consequences and if no police protection is granted, the life of the petitioner would be at peril. The learned Government Pleader for Home submits that investigation is in progress and in the absence of any order by a competent civil court, the question of providing police protection on mere asking, would not arise. To this, the learned counsel for the petitioner would submit that the petitioner may be permitted to make a representation expressing her grievance, in which event, the same may be directed to be considered in accordance with law.

Having regard to the above facts and circumstances, this court is of the view that if the petitioner is entitled for police protection, she is always at liberty to make a representation to the competent authority and in which event it is for the said authority to consider the said representation and take appropriation action in accordance with law.

With the above observation, the writ petition is disposed of. No costs. Miscellaneous petitions pending if any, shall stand closed. ------------------------------------------ C.PRAVEEN KUMAR,J DATE:21-06-2017
