THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.5282 of 2017 ORDER:

This petition is filed under Section 482 Cr.P.C. seeking to dispense with the presence of the petitioner in C.C.No.93 of 2014 on the file of the Court of the II Additional Judicial First Class Magistrate, Kadapa.

Heard the learned counsel for the petitioner. 3.

A perusal of the record reveals that the petitioner/sole accused is facing trial in C.C.No.93 of 2014 for the offence punishable under Section 138 of the Negotiable Instruments Act. The petitioner filed Crl.M.P.No.4102 of 2015 in C.C.No.93 of 2014 under Section 205 Cr.P.C. For one reason or other, the trial Court has not disposed of the said petition. 4.

At the time of hearing, the only relief sought by the learned counsel for the petitioner is to direct the trial Court to dispose of Crl.M.P.No.4102 of 2015 in C.C.No.93 of 2014 as expeditiously as possible.

Having regard to the facts and circumstances of the case and also the submission made by the learned counsel for the petitioner, the learned II Additional Judicial First Class Magistrate, Kadapa, is hereby directed to dispose of Crl.M.P.No.4102 of in C.C.No.93 of 2014, as expeditiously as possible, preferably within a period of twenty

(20) days from the date of receipt of a copy of this order.

With the above direction, the Criminal Petition is disposed of.
